Terms & Conditions
1. The Pollito Chipotle Club Program (Program) is operated and managed by Headstream Trading Pty Ltd ABN 98 622 008 968 of Shop 1-2, 88 Broadway, Crawley, WA 6009 (Pollito).
2. You agree to these Terms & Conditions if you:
a. Provide your details;
b. Verify your email account;
c. Use your Card;
d. Access the Program via Pollito’s website; or
e. Download and or use a compatible application.
3. To participate as a member in the Program:
a. Collect a membership card (Card) from Pollito’s restaurant or register online at pollito.com.au;
b. If collecting a Card, register the card online at pollito.com.au;
c. Complete and submit your details;
d. Once you have successfully registered, you must verify your account by clicking on the link sent via email or via SMS. Only verified members can redeem Points.
e. As a Member, you will be provided with a unique member number and barcode, that will be contained within the welcome email sent to the email address that you registered with.
f. Once registered you will be a Chipotle Club Member (Member, You)
4. It is your responsibility as a Member to advise Pollito of any changes to your account details including your name, email or mobile number as soon as practicable after the change. Pollito is not responsible for any late delivery or loss of benefits or rewards to Members because of your failure to notify us of any change in your details.
5. Incomplete or indecipherable Member registrations or other forms relating to the Program, may at Pollito’s sole discretion, be deemed ineligible for the Program or deemed invalid.
6. Participation in the Program is for personal use only and open to individuals 18 years and over. Individuals must have a unique and valid email address and mobile phone number. Individuals under 18 years must have parental or guardian approval prior to registering for the Program and the parent or guardian must read and agree to these Terms & Conditions. Pollito reserves the right to request the parent or guardian to confirm consent or provide evidence of consent of the individual’s participation at any time.
7. Members agree to only register one account as a Member. Multiple accounts per user (determined by name, email or mobile number) will result in the additional accounts being closed, and any benefits and rewards attached to any of the accounts cancelled or forfeited, at the absolute discretion of Pollito.
8. The Program provides its Members with benefits, including Pollito Points (Points). The Points are available at any Pollito restaurant in Australia, but exclude purchases made from third-party, on-demand, delivery services, including but not limited to UberEats, Deliveroo and MenuLog.
9. Pollito reserves the right, at any time, to verify the validity and status of actual or prospective Members, registrations, verification of account details and any benefits or rewards issued and redeemed, including a Member’s identity, age, email and mobile phone number.
10. In the instance of a dispute of identity an actual or prospective Member (including a dispute of personal details such as name, age, email or mobile phone number) then Pollito reserves the right, in its absolute discretion, to reject or otherwise determine the identity of the member.
11. Where the Member’s barcode associated with the Account is scanned at purchase and before the transaction is finalised then, ten (10) Points will be awarded to a Member’s Account for each dollar spent and paid to Pollito for any eligible item. Eligible items may change from time to time but Points do not accrue for purchases including or not limited to those where a staff discount was used, charity items, complimentary items, gift card purchases and payments on third-party, on-demand, delivery services. The spend amount per item will be rounded up to the next whole dollar amount. For example an eligible item with a value of $9.95 will accrue 100 Points.
12. When redeeming Points for eligible items in a Pollito restaurant, Members must have enough Points to redeem against the full value of the item using Points alone. The Points required to redeem an item is calculated as the price of the item in dollars multiplied by 100. For example, to redeem an item with a value of $9.95, then 995 Points are required. Points are redeemed by presenting the barcode associated with the Account at time of purchase and before payment is finalised. For any items not covered by a Points redemption (i.e. an excluded item) then alternative payment methods should be used.
13. Points cannot be used to pay for a transaction where a coupon or voucher has already been used in that same transaction.
14. Points and any associated benefits will expire and be forfeited if no new transactions are made on an Account in a consecutive 365 day period (Expired Points). The Account will not be terminated and a Member may still accrue Points in the future.
15. Your membership and Account in the Program will be become inactive three years from the last day of use.
16. The number of Points accrued for eligible items and the number of Points required to redeem an eligible item may change from time to time without prior notice to Members. This includes but is not limited to special promotions.
17. Point balances and rewards offered under the Program are not transferable, exchangeable or redeemable for cash. Points accrued in multiple Accounts cannot be combined.
18. Each Member is responsible for ensuring the correct number of Points have been accrued or deducted for any eligible transaction and Pollito is not liable to compensate a Member for incorrect accruals or deductions.
19. Personal information collected by Pollito will be used to communicate with Members and provide you with benefits and rewards under the Program. Participation in the Program is conditional to you providing the required personal information. You consent to receiving marketing communications via email or through the App, unless you advise us otherwise and you agree to the release of your personal information to authorised third parties as necessary to carry out the Program. 20. It is each Member’s responsibility to protect their account from misuse or unauthorised access and Member’s are responsible for all activity on their account. Pollito is not responsible for any unauthorised use or access of a Member’s account including use through a Members barcode, redemption of benefits or rewards by third parties, or the unauthorised use of any other rewards or benefits sent to a Member.
21. Pollito reserves the right to refuse a Member and their barcode should there be grounds to believe that the use is unauthorised, fraudulent or otherwise unlawful.
22. Pollito reserves the right, in its absolute discretion and without prior notice, to remove benefits or offers, terminate or disqualify any Member that Pollito has reason to believe has contravened these terms or has tampered or compromised any part of the Program that could jeopardise the fair and proper conduct of the Program. Failure by Pollito to enforce any of its rights at any stage does not constitute a waiver of those rights. Pollito’s legal rights to recover any loss, damages or other compensation from such offender are reserved.
23. Pollito may terminate the Program at any time, with or without notice, which may result in loss of benefits and rewards and the cancellation of all benefits and rewards associated with the Program. Benefits and rewards are not your property and may be revoked, cancelled, limited, or modified at any time, even though such action may affect your right to use previously received benefits and rewards.
24. Interpretation of these terms shall be at the absolute discretion of Pollito, whose decision will be final. Pollito is not liable for benefits and rewards that are lost due to fraudulent, unauthorised, or other unacceptable use.
25. Pollito’s decision in relation to all matters arising under this Program is final and binding, and no correspondence will be entered.
26. Any tax liability connected with receipt, use or redemption of any benefit or reward under the Program is the responsibility of the Relish Member.
27. To the extent permitted by law, Pollito will not be liable for any damages, loss or claim that you may suffer or incur (including but not limited to consequential loss) because of your use of the Program. The Program including all benefits and rewards is provided as supplied without any warranties of any kind either expressed or implied. Pollito disclaims all warranties of merchantability, non-infringement and fitness for a purpose or that the Program will be error-free or free from harmful code.
28. By reason of occasional technological difficulties, and to the extent permitted by Australian Law, Pollito will not be liable for any compensatory or exemplary damages arising out of or in any way connected with use of the Program including the App or inability to use the Program even if we have been advised of the possibility of damages. You release Pollito, its officers, contractors, employees and agents against all loss, claims, costs, demands, damages and liabilities related to use or inability to use the Program.
29. Pollito reserves the right to alter the Terms and Conditions of the Program in its sole discretion without prior notice.
30. Member Cards’ will be accepted at Pollito’s restaurant. From time to time some it may be prevented from processing a Program transaction due to circumstances beyond their control (e.g. internet outage). In those circumstances Pollito will not be liable for any compensation or damages for any missed Points or benefits.
31. Pollito reserves the right, in its sole discretion, to disqualify any Member who it has reason to believe has breached any of these Terms and Conditions, has tampered with the registration, Points accrual/redemption and/or account verification process, or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the Program. Errors and omissions may be accepted at Pollito’s sole discretion. Failure by Pollito to enforce any of its rights at any stage does not constitute a waiver of those rights. Pollito’s legal rights to recover damages or other compensation from such an offender are reserved.
32. Except for any liability that cannot by law be excluded, Pollito (including its respective officers, employees, contractors and agents) is not responsible for, and excludes all liability (including negligence), arising from, any personal injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of registration to, and participation in, the Program, including but not limited to:
a. any theft, unauthorised access or third-party interference;
b. accrual or redemption of Points;
c. any registration or reward claim that is late, lost, altered, damaged or misdirected (whether after receipt by Pollito or not) for any reason beyond the reasonable control of Pollito;
d. use of a Card or the Website;
e. accepting, using or taking a reward, entitlement or discount offer under the Program;
f. any tax liability incurred by a Member in connection with the Program, including in relation to accepting, using or taking any reward, entitlement or discount offer under the Program;
g. any communication to any Member that is late, lost or misdirected for any reason, including but not limited to spam filters operating on a Member's email account or other system configuration problems; and
h. any problems or technical difficulties or malfunctions of any telephone network or line, computer system, equipment, server or provider, software, technical problem or traffic congestion on the Internet (whether or not under Pollito’s control), including but not limited to any injury or damage to any individuals computer or technological device related to, or resulting from, participation or registration in the Program, downloading the App or any materials in the Program or otherwise accessing or using the Website.
33. Information collected from Members at the time of signing up to the Program is subject to the privacy policy listed at pollito.com.au/privacy (Privacy Policy) and this clause.
34. By becoming a Member, you acknowledge and consent to the sharing and disclosure of your personal information per the terms of the Privacy Policy and agree not to hold Pollito liable in this regard.
35. Members are unable to change their email address or date of birth in the App or the Website. If these details need to be updated the Member should contact Pollito using the Contact Us form on the Pollito website at pollito.com.au/contact
36. These Terms and Conditions are to be read in conjunction with, and subject to, any additional terms and conditions governing any particular reward, promotion, discount or offer operated by Pollito, and in the event of any inconsistencies, these Terms and Conditions will prevail.
37. The laws of Western Australia, Australia apply to the Program to the exclusion of any other law. Members submit to the exclusive jurisdiction of the courts of Western Australia, Australia.
